Claudio Peña is a cook working in Japan for many years.

He lost visa in 2011, and was detained by the immigration twice.

The second detention reached 2 years and a half in April 2020.

Claudio Peña had worked as a cook since entering Japan in Jan. 1996.

In the end of 2010, he left his previous workplace to work at a new restaurant to be established by his Japanese friend.

However, the 2011 great earthquake and Fukushima nuclear disaster made the Japanese friend decide to give up his plan and leave Japan.

Claudio Peña looked for a workplace, but he couldn’t find any.

Immigration Bureau did not extend his period of residence.

Peña was thus made undocumented and detained by the immigration.

Claudio Peña was over fifty then. He cannot return to Chile.

He has neither expectation to establish life again in Chile, nor family to support him after his return.

Moreover, Claudio Peña is a refugee.

During the 1973 Chilean coup, Claudio’s father was forced to help with the army’s persecution of activists and massacre.

After the democratization in 1990, the father reported what he had done to the Truth Commission.

However, this provoked hostility both from the right and the left.

The whole family became the target of right-wing persecution.

As the result, Peña’s family was forced to live separately.

Despite that, one night in 1992 in Santiago, Claudio Peña was abducted by unidentified attackers.

He was taken outside the city, beaten up, and seriously injured.

In the hospital, he had to keep the reason secret from the doctor

in order to avoid further persecution.

Claudio Peña had to leave Chile.

He initially flied to Europe, where he met a Japanese

who asked him to work his restaurant in Japan.

It is so cruel and unfair that Immigration Bureau ignores all the reasons above but order him deportation.

Besides cooking, Claudio Peña is also good at drawing.

He made many artworks describing what happened in East Japan Immigration Center.

When a detainee and named Deniz attempted suicide, Claudio drew the incident in a picture, with a message that he should be released immediately.

This shocking drawing attracted public attention.

Claudio Peña is so a kind person.

In spite of his own difficulties, he often helps other detainees.

For example, he shares his possessions with others.

He negotiated with the officers patiently for immediate medication for his friend Deniz when he suffered from toothache.

It is the time for him to be released.

I live in Japan for 25 years.

I lost my visa.

It’s so tough, but ….

I have now so many people to support me.

I really, really appreciate it.

And … I will do my best to be recognized as a refugee.

Japan’s asylum process is considerably strict, but I won’t give up, although it’s so tough to live under the status of Provisional Release.

To all my supporters, thank you from the bottom of my heart.

Thank you so much to everybody for supporting me.

And … I want to say to all the refugees in the world: Just fight, just fight.

I want to say thank you very much to all the people whose contact me to support me in the last days, also many people called me to insult me because we are in different ways.

I really would like how I said before many times: I don't want to talk about that film "Ushiku".

Everybody deserve respect, also the people involve in the film and also all of you and I ask for respect for my wasted mental health.

I will delet my letter that on Claudio Peña Free Page, but that is still how I think.

I don't want to talk about it anymore!

[2020/12/29] Thank you so much for your providing support for Claudio Peña between June 26 and October 31 and in December, which amounted to 456,000 JPY. Thanks to your support, Peña-san could pay for the lawyer in immigration and asylum procedures, for medical check, for the medicines, and for betterment of daily life (room heating etc.).

　ペニャさんはまた、難民申請にかかる証拠を準備するため、代理人の駒井知会弁護士との打ち合わせを重ねています。

　ペニャさんの父親は、ピノチェトの軍事クーデターに協力を強いられたことを民主化後に真実和解委員会に証言したせいで、一家全員が極右と極左の報復の標的になってしまいました。現にペニャさんは二度、左右それぞれの組織に拉致、暴行されています。

　これらの組織は公式にはチリに存在しないことになっていますが、しかしとりわわけ極右団体は、現在もなおチリの情勢に影響力をもっています。昨年10月からチリでは、経済的不平等と政府の不正義に反対し、ピノチェト期の憲法を新憲法に置き換えることを求める大衆運動が沸き起こっています（今年10月25日の国民投票で新憲法制定が決定）。しかしこの動きのなかで、軍部など体制内の保守派に後援された極右運動もまた活発化しており、しばしば警察や治安当局も極右運動を野放しにしたり援助したりしています。このことは、いまだにチリが、軍部やそのシンパによって標的にされた人にとって安全ではないことを示しています。

　そもそもペニャさんは、15年間にわたり合法的に在留し、日本社会のなかで働いてきた人であり、在留資格を失ったのも、2011年の震災にともなう不運が重なり、コックの仕事が続けられなかったからにすぎません。すでに60代になるペニャさんには、もはやチリに生活基盤はない一方で、日本でコックとして何の問題もなく働き生活していくことが可能です。このことだけでも、彼の在留が認められてしかるべきです。

　今後もペニャさんの活動へのご注目、ご支援を、どうぞよろしくお願いいたします。2021年がペニャさんにとって、そして支援者の皆さまにとって良い年になることを祈りつつ。

Thank you so much for your providing support for Claudio Peña in the previous campaign which amounts to 220,000 JPY.

However, I could not cover the amount he needs so far for legal and medical matters.

In addition, it recently turned out that the bone of Peña's left ear is broken. This is probably the cause of the noise he has suffered from since he was attacked by an unidentified group in Chile, his country of origin. It took an unexpectedly high cost for the examination of his ear.

Thanks to your support, the following costs for Claudio Peña have been covered partly until now. The contract with an attorney, the examination of his left ear, his glasses, dentistry. Peña and I really appreciate for your support.

Since the release from immigration detention in the end of May, Claudio Peña has been so active. For the right to stay, he has had meetings with his attorney Ms. Chie Komai, as well as searching for the proofs or documents to be submitted for the examination of his asylum application. He has been busy also for medical cure of his ear, eyes, and teeth. He works with the supporters of immigrants and refugees, and seeing immigration detainees in order to provide support for them. Recently, he had media interviews.

Non-visa holders have no permission to work for earnings. However, Claudio Peña always makes as much effort as possible, trying whatever he can do for and by himself.

Peña and I would really appreciate for your continuous support.

    Our friend Claudio Peña is, despite his being undocumented, a member of Japanese Society, where he lives for so many years as a cook and a drawing artist, and a refugee who experienced political violence targeting himself. It is absolutely unjust that Immigration Bureau of Japan leaves him undocumented and under the threat of deportation.

    Peña is about to start again the struggle for the right to live in Japan, to obtain asylum or at least residency permission. He needs your financial support for legal fee.

    Living in Japan so many years, Claudio Peña has hardly any hope of re-establishing his life in Chile. He also has a health problem which makes the enforcement of deportation highly dangerous for his life. Moreover, the political changes in Chile has created the concern of his becoming a target of persecution. Therefore, it is impossible for Pena to accept deportation order.

    The Immigration Bureau of Japan detained him twice, for 4 and a half years in total. In this country, no maximum period of immigration detention is legally determined, which makes it regular to implement immigration detention endlessly, ignoring rights and health of detainees, as a means to force them give up their application for asylum or regularization. Therefore, it can be said that immigration detention in Japan is in itself abuse, or even torture.

    Nevertheless, Peña endured this abuse, and was released from the detention center on May 25 this year. Now it is time for him to obtain the right to live in this country. He needs approximately 500,000 JPY for legal fee etc. Your donation helps Claudio Peña. Thank you in advance.

Pena had been worked for a long time in Japan as a cook since 1996. However, he lost the place to work in the aftermath of the Great Earthquake in 2011. Because of that, the Immigration did not allow him  the extension of the period of residence, and subsequently put him in custody. He was released in 2013 but put under immigration detention again in October 2017.

Living in Japan so many years, Pena has hardly any hope of re-establishing his life in Chile. He also has a health problem which makes the enforcement of deportation highly dangerous for his life. Moreover, the political changes in Chile has created the concern of his becoming a target of persecution. Therefore, it is impossible for Pena to accept deportation order in spite of the long-term detention, which already amounts to two years and six months.

Pena tries to report to the public the problems of immigration detention in Japan by his drawings, the part of which are (or will be) uploaded in this blog. He is so a kind person who, in spite of his own hardship, supports other detainees by sharing his possessions, negotiating with immigration officers in behalf of them, and so on.

However, Pena has an obstacle to solving his own problem. He needs a lawyer (attorney at law) who works for him in order to get the permission of provisional release (kari-homen), but he can neither afford it nor makes use of legal aid. Therefore, I ask you for donations for legal fee in order to help Pena out of immigration detention.
